After losing an appeal against the expansion and relocation of a local fish farm owned by Kelly Cove Salmon Ltd, Herschel and Marian Specter said they were disappointed but not dismayed that their challenge had been rejected by Nova Scotia Supreme Court. Herschel Specter said in a recent interview "that even though they lost the case it had given them access to all kinds of data that was not available to them before the case".
One of the issues that has been found in the documents was evidence on sulphide contamination in parts of the harbour, and this was recorded in the ministers own records but what was even more shocking to him was the fact that there was no explanation as to why the sulphide contamination was high, but said it was high enough that it would destroy sea life.
